(Chinhphu.vn) - According to regulations, within the scope of the source of savings, the agency which implements the autonomy regime shall be entitled to apply the increase coefficient of the maximum wage fund no more than one time in comparison to  salary rank, scale and position that be regulated by the State to pay additional income to officials, public servants  and employees.

The office of Mr. Nguyen Hoai Sa (in Dong Thap Province) is the administrative body (Sub-department of the Department) with personnel  of public servants and civil servants. Operational budgets include granted budget resource, fees collection resource, fees are deducted and service collection resource

At the end of the financial year, after balancing the expenditures (except administrative expenses for the civil servant personnel), the difference is higher than the expenditure, the regime (civil servants and officials). Then, the administrative budget of the civil servants remaining to spend for civil servants (employees are not entitled).

Regarding this issue, The Ministry of Finance responds as follows:

According to Article 2 of the Law on Officials: Officials who are Vietnamese citizens are recruited according to their jobs, work in public non-business units under the contractual regime and enjoy salaries from their wage funds of public service units according to the provisions of law.

According to the provisions of Clause 2, Article 4 of the Law on Cadres and Civil Servants: Civil servants are Vietnamese citizens, they are recruited, appointed to the ranks, positions and titles in the agencies of the Communist Party of Vietnam and the State, socio-political organizations at the central, provincial and district levels; In agencies and units of the People's Army, which are not officers, professional servicemen or defense workers; In agencies and units of the People's Police which are not professional officers and non-commissioned officers and in the leadership and management apparatus of the public service units of the Communist Party of Vietnam, the State, political and social organizations (hereinafter referred collectively to as public non-business units), on the personnel and entitle salary from the state budget; For public servants in the leadership and management of public non-business units, their salaries shall be covered by wage funds of public non-business units according to the provisions of law.

According to the above regulations, the structure of the number of people working at state agencies and public non business units is as follows:

- Public service units shall include: Civil servants in leadership, management of public non business units, civil servants and contract workers.

- State agencies shall include: Officers (elected, ratified, appointed to hold positions, titles according to periods, if any), civil servants and employees with indefinite terms for some titles in accordance with the law approved by competent authorities.

Subjects apply self-control mechanism

According to information that Mr. Sa provided, his agency is the administrative body. Where his agency has its own seal, account and direct use of administrative management funds, it is subject to the mechanism of autonomy and self-responsibility for the use of administrative management funds under Decree No. 130/2005 / ND-CP dated October 17, 2005 of the Government that has stipulated the regime of autonomy and self-responsibility for the use of staffing and administrative management funds for agencies. government; Decree No. 117/2013 / ND-CP dated 7 October 2013 of the Government amending and supplementing a number of articles of the Government's Decree No. 130/2005 / ND-CP dated October 17, Joint Circular 71/2014 / TTLT-BTC-BNV dated May 30, 2014 of the Ministry of Finance, Ministry of Internal Affairs regulates the mechanism of autonomy and self-responsibility on the use of administrative funds for the administration to State officials.

As stipulated in Joint Circular 71/2014 / TTLT-BTC-BNV:

- Funds for administrative management of agencies which implement autonomy and self-responsibility for the use of administrative management funds are determined and allocated annually according to Point a, Clause 2, Article 3 of Joint Circular No. Pursuant to 71/2014 / TTLT-BTC-BNV: Fixing wage fund according to the staff assigned by the competent authorities and fixing wage funds of the contractual employees for indefinite term for a number of titles according to the provisions of Laws approved by competent authorities; Expenditures on regular activities shall be based on the staff assigned by competent authorities and the norms of allocation of State budget expenditure estimates approved by competent authorities.

- The method of calculating the saving fund and content of using saving fund (supplementing incomes of officials, civil servant and employees, expenditures for rewards, collective welfare activities, setting up provision funds to stabilize incomes of cadres and civil servants) as stipulated in Clause 7, Article 3 of Joint Circular No. 71/2014 / TTLT-BTC-BNV; It has assigned the head of the agency which implements the self-management regime to decide on the above-said savings plan in the internal spending regulation of the agency after reaching an agreement in writing with the public organization. agency delegation.

- For the payment of increased income, Clause 8, Article 3 of Joint Circular No. 71/2014 / TTLT-BTC-BNV has stipulated as follows:

Within the scope of the source of savings, the agency which implements the autonomy regime shall be entitled to apply the increase coefficient of increase of the maximum wage fund no more than 1.0 (one) times in comparison to the salary rank, grade  or position due to The state stipulates to pay extra income to officials, civil servants and employees.

On the basis of the total expenditure allowed above, the agency that implements the self-management regime decides on the additional income payment plan for each cadre, civil servant and employees (or for each attached department). The specific payment level shall be decided by the head of the agency after reaching agreement with the trade union organization.

Therefore, we recommend you to research the regulation on the determination of savings funds, regulations on payment of increased income for officials, civil servants and labor contracts with indefinite term for some titles under Law provisions that are approved by competent authorities to strictly comply with the current regulations on the mechanism of autonomy and self-responsibility for the use of administrative management funds.
