Modification of taxes on goods processed from mineral resources

(Chinhphu.vn) - Through the system of receiving and responding to the recommendations of businesses, the business association on exploiting, processing and exporting stones proposed related agencies to remove difficulties in implementation of export tariffs for white marble  that have been processed.

Previously, enterprises were entitled to 0% export tax on white marble products which were processed, cut, sawed according to sizes, grinded glossily into finished products (wall, floor tiles...)

However, after October 26, 2016, enterprises received a request from Departments of Customs for declaration of 5% tax rate under the guidance of the Official Letter No. 9744 / TCHQ-TXNK dated October 12, of the General Department of Customs.

Through studying the Law on Import – Export Tax 2016, the Government's Decree No. 122/2016 / ND-CP of September 1, 2006 promulgating the Export Tariffs, the Preferential Import Tariffs, the list of commodities and the absolute tax rate, mixed tax, import tax not included in the tariff quota, white marble products are processed into finished products that be not subject to the list of taxable export tax goods of 5% because this item is not specified in the Export Tariff in Appendix I of Decree No. 122/2016 / ND-CP.

Decree No. 122/2016 / ND-CP does not specifically provide guidance on how to determine and apply export tax rates for export goods which are not specifically stipulated in the Export Tariff.

Business associations on exploiting, processing and exporting stones has sent an official letter to the General Department of Customs and be guided that the white stone and stone products have been processed have to determine the value of mineral resources plus energy costs represent a percentage of production costs to determine the export tax rate in accordance with the ordinance number 211 of the Export Tariff in Appendix I of Decree 122/2016 / ND-CP: "Semi-finished materials and raw materials have a total value of natural resources and minerals plus the cost of energy accounting for 51% of  product costs" and have an export tax rate of 5%.

However, the business association on exploiting, processing and exporting stones said that the above guidelines have no legal basis.

At present, businesses are having difficulties in clearing their shipments of white marbles, which have been processed with the total value of natural resources and minerals, plus the cost of energy accounted for 51% and more of product costs will be requested by provincial Departments of Custom for a declaration of 5% export tax, otherwise businesses will not be cleared.

During legal documents on amending the application of specific the export tax rate for this product that has not been issued, the business association of exploitating, processing and exporting stones would like to request related agencies to consider allowing businesses to continue declaring the export tax rate of 0% according to previous regulations.

Regarding this issue, The Ministry of Finance responds as follows:

Pursuant to the provisions of the Law on Import - Export Tax No. 107/2016 / QH13, the Export Tariff promulgated together with Decree No. 122/2016 / ND-CP shall take effect as from September 1, Item number 211 is as follows: "Semi-finished materials with total value of natural resources and minerals plus energy costs accountied for 51% of the product costs or more " and have the export rate is 5%.

Recently, the Ministry of Finance has received complaints related to tax policy for goods processed from mineral resources with the total value of mineral resources plus energy costs accounted for 51% cost of products or more.

Therefore, at present, the Ministry of Finance is studying and proposing amendments to Decree No. 122/2016 / ND-CP and Decree No. 100/2016 / ND-CP, in which it includes above contents to assure a scientific, be suitable to practice and contribute to remove difficulties and problems for businesses.
