Is it allowed to import refurbished IT products?

 (Chinhphu.vn) – Refurbished, remanufactured, renewable, recycled, reused, recertified ... products are refurbished, remanufactured, renewed, understood as IT products used in the IT product portfolio. Used import prohibitions when importing.

As reflected by Star Logistics Co., Ltd, the refurbished, remanufactured, renewed, recycled, reused, refurbished IT items are faulty items in the manufacturing and display process, refurbished and repaired on modern lines, machines are as new 100%.

However, these items are currently banned from importation. modern and advanced technology from the finished date to Vietnam are most less than a year, so the State banned import of this item, so that the access to new technologies of people are limited, especially  pupils and students.

Through the receiving and responding system to the recommendations of businesses, the Star Logistics Co., Ltd proposes the Government and the Ministry of Information and Communications to study and have more realistic regulations.

In addition, in the opinion of the Company, the Circular 31/2015 / TT-BTTTT is unclear, cause confusion in handling of civil servants and enterprises. The company requested the Ministry of Information and Communications to publicize the detailed guidance of this Circular on the Government's Electronic Portal.

Regarding this issue, The Ministry of Information and Communications responds as follows:

The Ministry of Information and Communication will study and advise the Government on the promulgation of policies for the management of IT goods, which are in line with the interests of the people, on the basis of international commitments that Vietnam has been and will be a member.

The ban on the import of used IT products has been implemented by the Ministry of Information and Communication since 2006 in order to limit the importation of electronic waste that pollutes the environment, contributing to the development of the IT industry in Vietnam and protection of consumers' interests in the country.

Regarding the proposal of Star Logistics Company, in 2016 and 2017, the Ministry of Information and Communication has sent documents to General Department of Customs, Tan Son Nhat International Border Gate and a number of enterprises (including the Star Logistics Co., Ltd) on guiding the identification of refurbished and recertified goods is included in Appendix 01 of the Circular 31/2015 / TT-BTTTT.

Specifically, the Ministry of Information and Communications has issued an Official Letter No. 2439 / BTTTT-IT dated July 20, 2016, the Official Letter No. 2897 / BTTTT-IT dated August 24, 2016, the Official Letter No. 3214 / BTTTT-ITT dated September 7, 2017 responds to the customs and business clearly and consistent in this regard as follows:

Clause 2, Article 2 of the Circular No. 31/2015 / TT-BTTTT has stipulated: "Refurbished IT products are used products which are repaired and replaced with components and other functional steps. , equivalent form and warranty mode as new product. Refurbished products must have a mark in Vietnamese indicating the refurbished product, or in English with equivalent meaning. "

IT products labeled as refurbished, remanufactured, renewed, recycled, reused, recertified ... have equivalent refurbished meanings as used IT products under the IT product portfolio. Use of import bans when importing.

In order to create a unified state management policy for the above mentioned issues, the Ministry of Information and Communication has asked the General Department of Customs to issue a document to instruct local customs offices and enterprises on the methodology as the basis for determining the goods on the list of those banned from import.
