Is it required to pay social insurance for part-time workers?

(Chinhphu.vn) - Mr. Bui Anh Tuan (in Hochiminh City) is using part-time employees at the store for VND 20,000 / hour. Mr. Tuan would like to ask, if he uses the part time workers for 8 hours or more, does he have to support any other costs? Does he have to pay social insurance for these workers?

Regarding this issue, Social Security of Ho Chi Minh City responded as follows:

Pursuant to Clause 3, Article 34 of the Labor Code 2012 it has stipulated that part-time workers are entitled to a wage and have the same rights and obligations as full-time workers, and are entitled to equal opportunities and to non-discrimination and assured labor safety and hygiene.

Pursuant to the Law on Social Insurance and the guiding documents under the Law stipulating the subjects participating in compulsory social insurance are those who work under labor contracts with indefinite term, definable labor contract, seasoning labor contract or for a fixed job with a term of between 3 months and under 12 months, including a labor contract signed between the unit and the legal representative of the person under 15 years of age in accordance with the law on labor; Labor contractor has term ranging from 1 month to less than 3 months (implemented from January 1, 2018). Compensation for social insurance premiums must not be lower than the minimum wage at the time of payment.

To comply with the above stipulations, in cases where companies and workers sign labor contracts with a term of between 1 month and under 3 months, companies must register for compulsory social insurance and workers shall still enjoy annual leave and severance allowances when terminating the contract as for full-time workers.
