Regulations on floor plan when applying for construction permits

(Chinhphu.vn) - Site planand planning drawings are two different drawings. Site plan is not required to show construction planning.

Mr. Bui Anh Dung (in Hai Phong Province) would like to ask,  authorities answer questions about construction permits for individual houses as follows:

Point a, Clause 3, Article 11 of Circular No. 15/2016 / TT-BXD stipulates the application for construction permit for detached house: “a) The site plan showing the location of the work on the land lot with scale of 1:50 – 1:500, enclosed with the work location diagram;”.

According to Mr. Dung, there is no specific regulation on presenting the plan of the construction with the diagram of the work location so there are many different understanding ways.

He applied for a construction permit for a project under the jurisdiction of the District People's Committee. According to subdivision planning scale 1/2000 for the district by the Hai Phong City People's Committee. approved, his land plot partially overlapped planning and partially overlapped with green planning (visual look on the planning map).

Mr. Dung submitted the project design document on the land lot and requested the licensing agency to specify how many overlapping areas were planned for him to adjust the design. However, the licensing authority did not show accurately how many areas of ​​his construction overlapped planning, but required the ground of the construction on the land lot must be shown:

- What is the situation around the lot (with roads, ponds, houses, ...).

- Planning indicators on the land lot (whether or not any road is open to all or part of the land).

- The area of the project is overlapped with the plan and the area of the project is not overlapped with the plan (with the design of the project, how much area is in the road planning, greenery planning. .. and planning residential land).

According to Mr. Dung's opinion, the above requirement of the licensing body was tight, however, to determine the exact area of the project and the land plot inside and outside the planning at the request of the licensing agency, they must hire a survey consultant to conduct the measurement.

Because the District People's Committee only received a license fee of VND 50,000 / license, there is not enough funding to pay for the measurement consultant, so the licensing agency requested Mr. Dung to pay the consultant rentfor surveying and measurement by himself.

Mr. Dung would like to ask, does the above request of the licensing agency about the determination of the ground drawing of the construction on the land lotof 1/50 - 1/500, attached to the prescribed plan of the location of the construction based on any regulations of   law? Does the construction plan have to show the plan?

Is it compulsory to hire a measurement consultant to determine the plan? In case of having to hire a consultancy unit to measure and accurately determine the area of ​​land and works in the planning, is the cost of hiring a consultancy unit paid by the people or the state management agency for planning?

The Ministry of Construction responds to this issue as follows:

According to the provisions at Point a, Clause 3, Article 11 of the Construction Ministry's Circular No. 15/2016 / TT-BXD dated June 30, 2016, guiding the granting of construction permits, The ratio of construction drawings of works is 1/50 - 1/500 based on the size of existing construction design drawings.

Site and planning drawing are two different drawings. Site plan are not required to show construction planning.

Mr. Dung can contact the local planning management agency for information on construction planning.

Organizations and individuals that hire consultancy units to measure and accurately determine the area of land and works included in the planning must pay the expenses.
